Terms of service
By signing up for Fidz, you agree to these terms. They're written in plain English so you can actually read them. If anything is unclear, email hello@fidz.app.
Fidz is operated by Adrien Pouchard, sole trader (individual) (ABN 89 169 486 121), based in Shepparton, Victoria, Australia.
1. The service
Fidz is a software-as-a-service that lets local businesses run digital loyalty programs delivered through Apple Wallet and Google Wallet, including push notifications, automated Google review requests, and customer analytics.
2. Eligibility
- You must be 18 years or older.
- You must operate a legitimate business with the legal right to collect customer data.
- You must comply with Australian Privacy Principles and any other applicable laws in your jurisdiction.
3. Plans, billing and trial
- You get a 14-day free trial when you sign up. A payment method (card) is required to start the trial, collected securely via Stripe.
- If you do not cancel before the trial ends, the plan you chose begins automatically and your card is charged. Cancel any time before the trial ends from the dashboard and you won't be charged.
- Plans are billed monthly (or yearly) in Australian dollars, euros or US dollars depending on your country, at the prices shown on the Pricing page. Euro prices exclude VAT: VAT, where it applies, is added according to your situation and shown on your invoice. Prices are shown GST-exclusive. For Australian customers, 10% GST is added at payment and itemised on your tax invoice (claimable as an input tax credit if your business is GST-registered). Customers outside Australia aren't charged GST.
- Money-back guarantee: you can take one full self-serve refund from the dashboard within 7 days of your first charge. After that window, or for a second request, refunds are handled case-by-case (see below).
- Setup fees are one-time and non-refundable once the on-site setup has been performed.
- Outside the money-back window, monthly subscription fees are prorated and refundable for the unused portion of a month if you cancel for cause (we breached the service-level commitments). This does not limit your non-excludable rights under the Australian Consumer Law.
- You can cancel anytime from the dashboard. Service continues until the end of the current billing cycle.
4. Your responsibilities
- You must obtain customer consent before enrolling them — the Fidz scan page includes a consent line, but you should also disclose your loyalty program at the counter.
- You must not enrol customers without their knowledge or consent.
- You must not send push notifications that are misleading, deceptive, or in breach of the Australian Spam Act 2003.
- You must not request Google reviews in exchange for rewards — Google may delist your business if you do.
- You must keep your login credentials secure.
- You are responsible for your customers' data — Fidz acts as a data processor on your behalf under our Data Processing Agreement.
5. Acceptable use
You may not:
- Use Fidz for illegal activities or to promote illegal goods or services.
- Send spam, harassment, hate speech, or content that violates anyone's rights.
- Attempt to break, hack, or reverse-engineer the service.
- Resell or rebrand the service without a written agreement (white-label is available — contact us).
- Use the service to compete directly with Fidz.
We may suspend or terminate your account at our discretion if we believe these rules have been broken. We'll notify you in writing first when possible.
6. Your data
You own your data. Your customer list, visit history, and campaign content remain your property. You can export everything as CSV from the dashboard at any time.
We license your data only to provide the service and to improve it (in aggregate and anonymised). See the Privacy policy.
7. Service availability
We aim for 99.9% uptime, calculated monthly. Scheduled maintenance is announced at least 24 hours in advance. If we miss the SLA for two consecutive months, we'll credit you one month free. Push notification delays caused by Apple or Google's infrastructure are outside our control and not counted toward the SLA.
8. Liability
To the maximum extent allowed by Australian Consumer Law, our liability for any loss arising from your use of Fidz is limited to the fees you've paid us in the 12 months preceding the claim. We're not liable for indirect or consequential losses (lost profits, lost goodwill, etc.).
Australian Consumer Law guarantees that cannot be excluded continue to apply.
9. Indemnity
You agree to indemnify Fidz against claims arising from your misuse of the service, your breach of these terms, or your failure to obtain proper consent from your customers.
10. Termination
Either party can terminate at any time. Upon termination:
- Your service stops at the end of the current billing cycle.
- Your data stays available for 60 days for re-activation.
- After 60 days, your data is permanently deleted.
11. Changes to these terms
We'll email you at least 30 days before any material change. Continued use after the effective date means you accept the new terms.
12. Governing law
These terms are governed by the laws of the State of Victoria, Australia. Disputes go to the competent courts of that jurisdiction.
13. Founder offer
- The founder offer gives 50% off the price of any plan (Solo, Growth or Multi-site, billed monthly or yearly) to the first 50 shops that subscribe.
- It applies to the invoices that follow the 14-day free trial; the trial itself stays free.
- It lasts for as long as your subscription stays active. It is not a lifetime price: if your subscription ends for any reason (you cancel, or it is closed after a failed payment), the discount ends and is not restored. If you subscribe again later, the normal price at that time applies. Changing plan, or switching between monthly and yearly billing, keeps the discount.
- A place is reserved for your shop when you open the payment page and is released if the payment is not completed within the life of that session (24 hours). When all the places are taken the offer closes automatically.
- If we ever stop the service, we give the notice described in section 11 (at least 30 days, by email), and you can export your data as described in sections 6 and 10.

- L'offre fondateur accorde 50 % de remise sur le prix de n'importe quelle formule (Solo, Growth ou Multi-site, en facturation mensuelle ou annuelle) aux 50 premiers commerces qui s'abonnent.
- Elle s'applique aux factures qui suivent l'essai gratuit de 14 jours ; l'essai reste gratuit.
- Elle dure tant que votre abonnement reste actif. Ce n'est pas un tarif à vie : si votre abonnement prend fin, quelle qu'en soit la raison (résiliation, ou clôture après un paiement refusé), la remise s'arrête et n'est pas rétablie. Si vous vous réabonnez plus tard, le prix normal en vigueur à ce moment s'applique. Changer de formule, ou passer du mensuel à l'annuel, conserve la remise.
- Une place est réservée pour votre commerce à l'ouverture de la page de paiement et libérée si le paiement n'est pas terminé pendant la durée de cette session (24 heures). Quand toutes les places sont prises, l'offre se ferme automatiquement.
- Si nous arrêtons un jour le service, nous respectons le préavis décrit à l'article 11 (au moins 30 jours, par e-mail), et vous pouvez exporter vos données comme prévu aux articles 6 et 10.
